TERMS AND CONDITIONS

This Terms and Conditions of Membership (the "Agreement") is entered into by and between Live Well 30A Membership, LLC a Florida LLC (the "Company") and you (the "Member") on the date Member enrolls in the Membership. The following Terms of Service apply to Members joining on or after October 15, 2023.

By enrolling in the Live Well 30A Membership, Member agrees to the following terms and conditions. 

In consideration of the mutual covenants and agreements contained herein, the parties agree as follows: 

1. Termination without Cause

Notwithstanding any other provision in this Agreement, the Live Well Membership reserves the right, at its sole and absolute discretion, to terminate the membership at any time without cause. The Member acknowledges and agrees that they shall have no claim for any damages, compensation, or reimbursement of any kind against Live Well Membership arising out of or in connection with such termination.

2. Membership Benefits 

  • Upon payment of the Membership fee, the Member shall be entitled to the following benefits: 

  • Access to the Company's website and online resources Participation in the Company's events and programs including 16 vouchers to our weekly Member’s only bonfires 

  • Welcome box 

  • Member cards and discounts on products and services offered by the Company and partners. 

  • Our trip planning and concierge team 

  • 14 days of off-season home use. Additional off-season Housekeeping Only Stays can be added for a fee. 

  • Seven days of off-season vehicle use

  • Premium Membership: During off-season weeks, the max capacity guaranteed for a Premium Membership Housekeeping Only Stay is a three bedroom home that sleeps six people. Additional bedrooms/guests may be added to a stay for a fee.

  • Premium Plus+ Membership: During off-season weeks, the max capacity guaranteed for a Premium+ Membership Housekeeping Only Stay is a four bedroom home that sleeps eight people. Additional bedrooms/guests may be added to a stay for a fee.

3. Membership Fees

The Membership fee is charged monthly or annually, depending upon the terms at the time of registration. The Membership fee is due and payable upon the Member's acceptance of this Agreement. Membership fee is dependent upon the date of registration.

4. Term of Membership 

The term of this Agreement shall be for one month or one year, depending upon the terms at the time of registration. The Member may renew their Membership for an additional month or year by paying the Membership fee. This will happen automatically each month or year, respectively. 

5. Membership cancellation

Membership can be canceled at any time with 30 days written notice. Please fill out this form with your request to cancel. Monthly paying Members will be charged one additional month upon cancellation. Annual Memberships that are canceled early will not be reimbursed. Annual Memberships that are canceled 30 days prior to the associated annual renewal date will not be charged. All Membership dues are non-refundable. Members who cancel their Live Well Membership after redeeming an off-season Member stay will not be invited or allowed to rejoin in the future.

6. Other cancellation fees 

Member bonfires: Premium and Premium Plus Members receive 16 vouchers for Member bonfires each year. VIP Members receive unlimited bonfire vouchers. There is no additional charge for the vouchers. Should Members RSVP “attending”, then cancel after 10AM CST on the day of the bonfire, there is a cancellation fee of $200 per group. For this reason, we encourage Members to only RSVP to our Member fires if they are certain they will attend.

Housekeeping only home rentals: Canceling within 30 days will result in a cancellation fee of $500 per night plus the housekeeping fee. Canceled off-season days are not re-deposited for future use. All nights of the stay are subject to this policy. This includes booking nights that Members do not need and/or do not use (including but not limited to late arrivals and early departures.) If at any point during a scheduled and confirmed stay, the primary guest is not present, Member account will be subject to this $500 per night charge. For this reason, we encourage Members to only book when they are 100% certain of their trip dates.

All other home rentals: Our trip planning team completes reservations requests with the use of partner properties. For All Member Stays, Member agrees to follow the property manager’s rental policies. Member Liaison will send you the rental policies associated with your property at the time of confirmation.

7. Membership fee refunds 

We do not refund Membership fees. 

8. Credit card charges 

The credit card used to sign up for the Membership will be automatically charged each month or year, respectively for the Membership fee. This card will also be automatically charged for any additional purchases made to the Member’s Membership account. This includes but is not limited to: housekeeping fees, home rentals, bike rentals, beach chair rentals, transportation, etc. Processing fee of 3% will apply to any “additional purchases” such as the aforementioned.

By enrolling in the Live Well 30A Membership, Member authorizes Live Well 30A Membership to charge the credit card used to purchase Membership each month or year, respectively for the monthly or annual dues and the Member’s additional charges. 

Family Members listed on Membership account are also authorized to make charges to the associated Member account. 

9. Other fees

By enrolling, Member agrees an authorizes the following charges: 

Member bonfires: Additional vouchers (after the 16 per year have been used) are $25 per person per fire. Children under 12 are free. 

Housekeeping only Member stays: Each time a Member uses a Member home during the off-season there will be an associated housekeeping fee. Housekeeping fees are as follows:

  • 1 Bedroom: $195

  • 2 Bedroom: $225

  • 3 Bedroom: $325

  • 4 Bedroom: $425

  • 5 Bedroom: $525

Should the Member home be located in Watercolor or Seaside, an additional amenity fee will apply. Amenity fees are typically charged on a "per night" basis.

Car Service: Should a Member choose to have a Jeep, Suburban or other car to be waiting at the airport upon arrival or departure; associated fees will apply.

10. Guests and gifting Membership benefits 

Members are welcome to bring family &/or guests. During off-season weeks. Max capacities still apply, respective to the Membership type.

All Membership benefits can be gifted to friends over the age of 27. Member must connect guest with Member Liaison via email, text, etc. Any charges guests makes will be billed to Member account unless alternative arrangements are arranged.

11. Pets 

Pets are not allowed in Member homes unless specified on the listing page. Pet fee will apply. Pet friendly homes allow well behaved dogs only and they must be 40 lbs or less. Cats are not allowed in any of the Member homes. Unauthorized presence of pets will subject Members and guests to termination of reservation and eviction from rental property. Excessive barking may lead to termination of reservation and eviction from rental property. Should the home be left with urine stains or other damages from pets, your Membership will be terminated.

12. Housekeeping only stays 

Each Member can use our Member homes 14 nights per year during the off-season within one year of the Member’s date of enrollment. This can be one 14 day stay or broken up into multiple stays. A housekeeping fee must be paid for each stay. Any unused days do not roll over beyond the annual renewal date based on time of enrollment. 

13. Vehicle Rental Benefits

Each Member can use our Jeep or Suburban 7 nights per year during the off-season within one year of the Member’s date of enrollment. This can be one 7 night stay or broken up into multiple stays. Any unused days do not roll over beyond the annual renewal date based on time of enrollment. By using the Live Well vehicle benefit, Members agree to the following terms:

  • Client has insurance that is up to date and covers rental cars and should an accident occur, client and/or client’s insurance will cover all liability and repairs for Company’s vehicle and any other vehicle involved.

  • Client will not allow anyone under the age of 30 to operate Company’s vehicle at any time.

  • Vehicle is not to be used on the beach or any unpaved roads.

  • Smoking is not allowed in vehicle.

  • Client is responsible for making sure the car is under cover and/or top is up in case of rain.

  • Client has acknowledged condition of vehicle below and agrees to return in the same condition.

  • Vehicle will be delivered on a full tank of gas. If not returned with a full tank, a fuel charge will be added.

  • No smoking, no pets, no driving on beach: $250 fine

  • Vehicles are to be used on 30A only.

  • The list of dates present in these terms will be updated in the fall each year.

15. Rules of Membership. Failure to adhere to these rules can result in fines and/or immediate Membership termination. The Member agrees to abide by the following rules of Membership: 

  • The Member shall not post any defamatory, offensive, or illegal content on the Company's website or online resources.

  •  The Member shall not use the Company's website or online resources to spam or harass other members.

  • Unless the Member chose a pet friendly property and paid a pet fee, the property is not pet friendly and pets are not allowed. Cats are not allowed in any Member homes, including pet friendly ones. Should the home be left with urine stains or other damages from pets, your Membership will be terminated.

  • All properties require that the primary Member be present at all times throughout the stay. If the stay is being gifted it must be approved seven days prior to check in and the recipient must be at least 27 years old. If guest request any additional services (gear rentals, transportation, etc) the default payment method will be the Member’s card on file.

  • Only guests on the rental request form can stay at the property. If Member has visitors during their stay, the total number of people at the property (night or day) cannot exceed the max occupancy of the property.

  •  Check-in/out times are typically 4pm check in and 10am check out. Your vacation coordinator will confirm the exact check in out time, as some properties have earlier or later check-in / check-out times. We do not have the ability to accommodate early check ins and/or late checkouts. Additional charges will apply for early arrival or late checkout.

  •  Members are responsible to abide by property rules including trash pick up days and specific check-out instructions. This information will be provided by your vacation coordinator upon check-in. Members are also responsible for equipment that comes with the property including but not limited to: bikes, beach gear, baby gear, etc. Please note that bikes typically require waivers to be filled out in order to unlock/use them.

  • Should the home be left excessively dirty, your Membership will be terminated.

  • Smoking or vaping is not allowed in or around the property. Smoking or vaping in or around the property may result in a $500 fine. Please note: Member homes are inspected upon arrival and departure.

  • If you rented a golf cart with our preferred vendor through your Membership, you understand that it cannot be used in Rosemary Beach or Alys Beach. Golf cart use in Watercolor and Seaside is restricted. Designated common-area parking lots have varying regulations in Watercolor and Seaside. Please check signage before parking to avoid fines.

  • Each property has individual parking restrictions. Details on parking as well as access to parking passes will be provided by your coordinator. No boats, trailers, RVs, etc are allowed at any Member, or partner properties.

16. Consequences for Breaking the Rules 

If the Member breaks any of the rules of Membership, the Company may take any of the following actions: 

  • Warn the Member 

  • Suspend the Member's account 

  • Terminate the Member's Membership 

17. Governing Law 

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. 

18. Entire Agreement 

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. 

19. Severability 

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from this Agreement and the remaining provisions shall remain in full force and effect. 

20. Waiver 

No waiver of any provision of this Agreement shall be effective unless in writing and signed by both parties. 

21. Notices 

All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered in person, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

22. Assignment 

This Agreement may not be assigned by either party without the prior written consent of the other party. 

23. Headings 

The headings in this Agreement are for convenience only and shall not affect its interpretation. 

24. Counterparts 

This Agreement may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
